The Dark Knight's screenplay isn't what makes the film what it is. On paper it could read very differently and relies heavily on character acting and action sequences to bring it to fruition whereas most other nominated screenplays more often focus on character development and plot. I'm not attacking the intelligence of the screenplay though, just offering a reason why most people would leave it off of their list.

With a score of 52% on Rotten Tomatoes, I think that we can officially cross Australia from the Best Picture slate. Probably Best Actress too, unless Nicole Kidman pulls a Cate Blanchett a la Elizabeth: The Golden Age.
On the other hand, maybe it's time to start adding Frost/Nixon to the line-up. With 92% on Rotten Tomatoes, it's looking to be Ron Howard's best-reviewed film since Apollo 13.
